321 Studios, makers of DVD X Copy and Copy Plus 4.2, filed a lawsuit against nine major motion picture production companies - MGM Studios, Tristar Pictures, Columbia Pictures, Sony Pictures Entertainment, Time Warner Entertainment, Disney Enterprises, Universal City Studios, The Saul Zaentz Company and Pixar Corporation; to avert their threats to stop the production and sale of these fantastic software programs.
Asking the federal courts to decide whether its software bundle DVD Copy Plus violates American DMCA law or not. While the law does not expressly prohibit copying of digital works — only the distribution and use of tools that circumvent copy prevention technologies — it ultimately affects the consumer’s right to copy DVDs, eBooks, and any other digital media that has been encrypted.
Citing 321 Studios’ free speech rights under the First Amendment, the complaint asks the court to rule that the sale of DVD Copy software does not violate key provisions of the DMCA or unlawfully aid consumers in infringing copyright privileges associated with material stored in the DVD format. The suit seeks a declaratory judgment that will permit 321 Studios to continue to sell DVD Copy Programs. No damages are sought.
This lawsuit involves the ability of an Internet company to market and sell an instruction manual and bundled computer software that teaches legal owners of DVD movies to make legitimate backup copies of the contents of a DVD for their own personal use.
